Indemnification

User Conduct

In using this Site, you agree not to disrupt or interfere with the security of, or otherwise abuse the Site, or any services, system resources, accounts, servers or networks connected to or accessible through the Site or linked web sites. You agree not to disrupt or interfere with any other user's enjoyment of the Site, use or attempt to use another's account, service or system without authorization from Konarka, or create or use a false identity on the Site. Enforcement of Terms and Conditions

This Agreement is governed and interpreted pursuant to the laws of The Commonwealth of Massachusetts, notwithstanding any principles of conflicts of law. You expressly agree that exclusive jurisdiction resides in the courts located within The Commonwealth of Massachusetts. You further agree and expressly consent to the exercise of personal jurisdiction and to venue in The Commonwealth of Massachusetts in connection with any dispute or claim involving Konarka and to the waiver of any right to a jury trial in connection therewith. If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions.

Infringement Notices and Take Down

Konarka prohibits the posting of any information that infringes or violates the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. If you believe that any material contained on this Site infringes your copyright, you should notify Konarka of your copyright infringement claim in accordance with the following procedure. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Konarka.
